Ukrtransnafta has complained in Antimonopoly Committee on the Ukrtatnafta and Halychyna NPK

PJSC Ukrtatnafta and JSC CPP Galichina prevents the return of the technological oil, owned by OJSC Ukrtransnafta. This is stated in the message the press service of the AMC.

The Antimonopoly Committee has provided for consideration of mandatory recommendations to JSC NPK Halychyna and Ukrtatnafta PJSC on the adoption of measures to prevent the Commission of violations of the legislation on protection of economic competition.

This decision was taken after the AMC asked the JSC Ukrtransnafta, a statement of the refineries committing anticompetitive concerted actions.

The Committee found that in the absence of significant changes in the state facilities rent PJSC Ukrtatnafta and Halychyna JSC NPK almost simultaneously increased the cost of renting storage tanks for oil storage. In addition, currently the cost of renting the property under the relevant contracts is identical and is 6.4 USD for 1 tonne per day (VAT included).

"Such actions PJSC Ukrtatnafta and Halychyna JSC CDD when concluding contracts with OJSC Ukrtransnafta, the pricing and terms of these agreements, under certain conditions, can have the characteristics of an agreed competitive behavior of economic entities", - is told in message AMKU.

The authority stressed that, in accordance with the terms and conditions of the lease of storage tanks for oil storage PJSC Ukrtatnafta and Halychyna JSC RPC are obliged to ensure technical and technological unimpeded return of oil from the leased containers at the first request of JSC Ukrtransnafta, or in the event of termination of these contracts.

The appeal of OJSC Ukrtransnafta to return the oil stored in a rented storage vessels, PJSC Ukrtatnafta and Halychyna JSC NPK almost simultaneously led to the return of oil to the conclusion of the pledge agreement.

"Action PJSC Ukrtatnafta and Halychyna JSC NPK in terms of creating unnecessary obstacles to the return of technological oil, owned by JSC Ukrtransnafta, can lead to restriction of production of oil products, which could have an adverse effect on competition in the markets of oil products" - according to the AMCU.

In this regard, the Antimonopoly Committee has provided for consideration of mandatory recommendations to JSC NPK Halychyna and Ukrtatnafta PJSC on the adoption of measures to prevent the Commission of violations of the legislation on protection of economic competition in the provision of JSC Ukrtransnafta services for the storage and/or leasing of storage tanks for oil storage.

About results of consideration of recommendations of the entities must inform the AMCU within ten days from the date of receipt.
